Counter-Notification Procedure

If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent. The counter-notification must include the following information:

  1. Your full name, mailing address, telephone number, and email address.
  2. A description of the material that was removed or disabled, and the location on our website where it appeared before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your consent to the jurisdiction of a federal court in the district where you reside or, if outside the United States, the judicial district in which Down4pc is located.
  5. Your consent to accept service of process from the party that submitted the DMCA takedown notice or its agent.
  6. Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the party that submitted the original DMCA takedown notice. If the original complainant does not file a legal action within 10 business days, we may restore the removed material as per the DMCA.
